11.2 Mediation

If the dispute cannot be resolved through internal procedures, both parties agree to attempt to resolve the dispute through mediation administered by a mutually agreed-upon mediator or mediation service operating within the Philippines. The costs of mediation shall be borne equally by both parties unless otherwise agreed.

11.3 Arbitration

If mediation fails to resolve the dispute within sixty (60) days, the dispute shall be finally settled by binding arbitration in accordance with the arbitration rules of the Philippine Dispute Resolution Center, Inc. (PDRCI) or another arbitration body mutually agreed upon by the parties. The arbitration shall be conducted in English and shall take place in Metro Manila, Philippines. The decision of the arbitrator shall be final and binding on both parties.

11.4 Jurisdiction

Notwithstanding the foregoing arbitration provisions, either party may bring an action in a court of competent jurisdiction in the Philippines for injunctive relief or to enforce an arbitration award. You agree to submit to the personal and exclusive jurisdiction of the courts located within Metro Manila, Philippines for the purpose of litigating any such claims or disputes.

11.5 Class Action Waiver

You agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against ffc777.

12. Amendments to Terms and Conditions
